Age Verification Policy

1. Introduction

SpicyGen AI ("we," "our," or "us"), operated by Wayfinity Ltd, Republic of Cyprus, is an adult content service for people aged 18 or over. This page is our public statement of the age assurance we use: how we check age, where a third-party check is required, how long an age-checked session lasts, and what data we keep. It describes our systems as they work today.

2. Where a Third-Party Age Check Is Required

We require a third-party age check (section 3.3) before showing NSFW images and videos to visitors in the United Kingdom, France, Germany, Italy, Australia, Brazil, and in these 27 US states: Alabama, Arizona, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Carolina, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, West Virginia, Wyoming.

We work out where you are from your network connection. Everywhere else, the entry confirmation in section 3.1 applies.

3. How We Check Age

3.1 Entry Confirmation (All Visitors)

When you first open SpicyGen in a browser, a pop-up asks you to confirm that you are 18 or over before you can use the site. It cannot be closed without confirming. Your confirmation is remembered in that browser.

3.2 Sign-Up

The sign-up screen states that by continuing you agree to our Terms of Service, which require you to be 18 or over.

3.3 Third-Party Age Check (VerifyMy)

In the places listed in section 2, NSFW images and videos are withheld or blurred until you pass a one-time age check with VerifyMy, a third-party age verification provider. We offer the check after your first purchase. Buying credits does not depend on the check.

VerifyMy runs the check on its own pages, under its own privacy policy. We first ask VerifyMy for an ID document scan with a face match. Where that method is not available for your region (for example, Italy), VerifyMy offers the methods set up for that region, which can include:

• Government-issued ID verification.
• Credit card or financial account check.
• Mobile network operator data.
• Digital identity or facial age estimation technology.

A passed check is stored on your account, and you are not asked to repeat it when you sign in again.

3.4 Session Rules in Italy, France and Tennessee

If you can see NSFW content and you are in Italy, France or Tennessee, the website signs you out:

• Italy: after 45 minutes of inactivity, or when you close the browser.
• France: after 1 hour of inactivity, or when you close the browser.
• Tennessee: 60 minutes after you signed in, or when you close the browser.

4. Data Collected During Age Verification

4.1 Data We Hold

• From the entry confirmation: that you confirmed, when, and your IP address, browser user agent and approximate location at that moment.
• From VerifyMy: whether you passed, VerifyMy's reference for the check, the method and age threshold VerifyMy reports, and when the check was completed.
• A log of each verification attempt and its result, for audit purposes.

4.2 Data We Do Not Hold

• We do not receive or store copies of identity documents.
• We do not receive or store the images or biometric data VerifyMy uses for its check.
• We do not receive your date of birth or exact age from VerifyMy, only whether you meet the minimum age threshold.

All data is processed in accordance with our Privacy Policy, including your rights under GDPR and other applicable data protection laws.

5. False Age Declaration

Providing a false declaration of age to access our Service is a violation of our Terms of Service and may constitute a criminal offence under applicable law. If we find that an account belongs to someone under 18, we close it.

6. Parental Controls

We strongly encourage parents and guardians to use parental control software and internet filtering tools to prevent minors from accessing adult content online. Age verification is one layer of protection, but parental supervision and filtering tools provide additional safeguards.

• GDPR / Cyprus Law 125(I)/2018: lawful processing of personal data in connection with age verification, supervised by the Commissioner for Personal Data Protection (Cyprus).

Wayfinity Ltd is established in Cyprus, where the Radiotelevision and Digital Services Authority (RTDSA) is the regulator for audiovisual and digital services.

8. Changes to This Policy

We update this page when our age checks or the places they apply to change, and change the date at the top.
