AI Policy

Last Updated: 6 October 2026

1. Introduction

SpicyGen AI ("we," "our," or "us") uses artificial intelligence technologies to provide our video and image generation services. This AI Policy explains how our AI systems function, the safeguards we have in place, the limitations of our technology, and your rights as a user. It is written with the transparency rules of the EU AI Act in mind; section 3 says which labelling measures are in place today.

2. How Our AI Systems Work

Our Service uses third-party AI models to generate images and short videos from text prompts, saved characters, images in your library, and reference photos you upload. The process involves:

  • Receiving a text prompt, and optionally a character, a library image, or a reference photo, from the user.
  • For a reference photo: an AI model describes the photo in text (pose, clothing, setting, and general appearance; it is instructed to leave out identifying facial details), and a new image is drawn from that description. The photo itself is not animated or edited into the output.
  • Processing the input through a generative AI model to produce an image or video.
  • Returning the generated output to the user within their account.

Generated outputs are created automatically and do not reflect the opinions, views, or endorsements of SpicyGen AI.

3. AI Content Disclosure and Labelling

All images and videos produced through the Service are AI-generated, synthetic content. Every output displayed in your account, in our galleries, and on any public pages is created by generative AI models. No output is an authentic photograph or recording. An output made from a reference photo is a new image, but it can share general features with the photo, such as pose, clothing, hair colour, or build.

We disclose the synthetic nature of this content through:

  • This policy, which states that all generated content is AI-created and synthetic.
  • A notice in the site footer that the content is AI-generated.

Generated images and videos carry a machine-readable AI label in their file metadata: the IPTC "trainedAlgorithmicMedia" digital source type in XMP (the field that major platforms and content credentials tools read as AI-generated), and on images an "AI-generated image, SpicyGen" note in EXIF. Some apps and sites remove metadata when a file is shared. Outputs do not carry a visible "AI-generated" label or signed C2PA content credentials. If you share an output, do not present it as a real photograph or recording.

4. AI Content Moderation

We use automated AI systems to moderate content uploaded to and generated by our platform. These systems are designed to:

  • Screen prompts for minors, real people (named or described), non-consent, violence, and other prohibited themes before generation.
  • Estimate the age of everyone in an uploaded photo and refuse the photo if anyone may be under 18.
  • Compare uploaded files against hash lists of known abusive or banned images (exact copies only), and faces against faces registered through TAKE IT DOWN requests.
  • Estimate the age of people in every generated image and video, and withhold any output in which someone appears to be under 18.
  • Flag content that may be child sexual abuse material (CSAM) for reporting.

Most moderation decisions are made automatically. Our staff handle appeals and abuse reports. If your content is rejected, you may contact us at contact@spicygen.com to request a review.

5. Prohibited AI Uses

You must not use our AI systems to:

  • Generate content depicting real identifiable individuals without their explicit documented consent.
  • Create deepfakes, synthetic media, or impersonations of any person (public or private).
  • Generate or attempt to generate any content depicting minors in sexual situations.
  • Produce content intended to harass, defame, or harm any individual.
  • Attempt to circumvent or manipulate our moderation systems through prompt engineering or image manipulation.
  • Use outputs for disinformation, fraud, or any illegal purpose.

Violations can lead to a refused request, a warning, or suspension or closure of the account and, where required by law, reporting to relevant authorities including the National Center for Missing & Exploited Children (NCMEC).

6. Limitations of AI-Generated Content

AI-generated content has inherent limitations and unpredictability. We do not guarantee that outputs will:

  • Meet your specific expectations or creative requirements.
  • Be accurate, complete, or free from artefacts.
  • Be consistent across multiple generations from similar inputs.

Credits used for generation are consumed regardless of whether the output meets your expectations, due to the immediate computational costs incurred. Please refer to our Refund Policy for information on dispute resolution.

7. AI and Personal Data

When you upload an image, it is processed by our AI systems. Uploaded images may contain biometric data (facial features). We process this data solely to:

  • Generate the requested video output.
  • Screen for prohibited content (for example, people who may be under 18, or faces registered through TAKE IT DOWN requests).

We do not use uploaded images to train our AI models unless you provide separate explicit consent to do so. For full details on how your personal data is handled, please read our Privacy Policy.

8. Transparency and Human Oversight

  • Disclosure: All video and image content produced on this platform is AI-generated, as described in section 3.
  • Human oversight: Our staff handle abuse reports and appeals. You can ask for a human review of an automated decision that affects your account (for example, a suspension) by emailing contact@spicygen.com.
  • No high-risk AI use: Our AI systems are not used for hiring, credit scoring, law enforcement, or other high-risk applications as defined under the EU AI Act.

9. Intellectual Property of AI Outputs

AI-generated outputs produced using your inputs are owned by you, subject to the licence you grant us under our Terms of Service. You are responsible for ensuring that your use of AI outputs complies with applicable intellectual property laws. SpicyGen AI makes no warranties regarding the copyright status of generated outputs.

10. Third-Party AI Providers

Our Service relies on third-party AI model providers to generate content. These providers operate under their own terms of service and acceptable use policies. We select providers that align with our content safety standards, but we are not responsible for the underlying model behaviour beyond what we control through our own moderation layers.

11. Reporting AI Misuse

If you believe our AI systems have been used to create harmful, illegal, or non-consensual content, please report it immediately:

We aim to respond to reports within 24 hours, and we act on valid TAKE IT DOWN Act requests within 48 hours. We remove content that we confirm breaks our rules, and we report apparent child sexual abuse material to NCMEC.

12. Changes to This Policy

We may update this AI Policy as our technology evolves and as laws and regulations change. Material changes will be communicated via email or a notice on our platform. Continued use of the Service after changes are posted constitutes your acceptance of the updated policy.
